Chautauqua Health And Rehabilitation Nursing Home Abuse And Neglect Allegations – Cited With Multiple Violations

April 28, 2022 Insights

Not all rehabilitation facilities are equal. Many combine short-term and long-term care, meaning some people are residents and some are patients. It is critical that the two sides remain separate for the health and safety of residents who are often there for end-of-life care. Placing a loved one in a nursing home or rehabilitation facility can be a difficult decision and ensuring they are properly cared for is top of mind. But what happens when your chosen facility ignores consistent resident abuse at the hands of short-term patients?

Chautauqua Health and Rehabilitation, located in Owensboro, KY, has a history of poor regulatory compliance. They have been fined twice in recent history: $608,228 in 2019 followed by $99,967 in 2021. Two surveys in 2021 from the Kentucky Cabinet for Health and Family Services revealed the depth and breadth of their violations in a 31-page report and a subsequent 140-page report. The violations are indicative of the true conditions within the facility as it was fined for not protecting residents from aggressive patients.

The Cabinet for Health and Family Services cited Chautauqua Health and Rehabilitation for five instances of “freedom of abuse, neglect, and exploitation deficiencies,” seven “quality of life and care deficiencies” and two resident rights deficiencies. The inspectors noted that the facility rated a “5” on a 1-5 harm scale, noting that Chautauqua Health and Rehabilitation failed to “timely report suspected abuse, neglect, or theft and report the results to the proper authorities” and failed “to protect each resident from all types of abuse, such as physical, mental, sexual abuse, physical punishment and neglect by anybody” and failed to “respond appropriately to all alleged violations.”

The Cabinet report shows that violations were corrected by November through staff training.

Long-term residents of combination facilities should never fear for their safety or health. The signs of abuse or neglect can manifest psychologically in the forms of agitation, withdrawal, or fear. Physical warnings, such as malnutrition and weight loss or unsanitary or unclean conditions can indicate larger problems with the facility. And finally, medical concerns such as overdoses and infections indicate a lack of oversight and nursing home abuse and neglect.
